1. Contractual Relationship and Acceptance
These Terms and Conditions regulate the access and use of the browser extension, the Volume Audio sound processing infrastructure, and the volume.audio website (hereinafter collectively referred to as the 'Software' or the 'Services'). By installing the extension or using our services, you agree to be legally bound by these clauses. If you do not agree with any part, you must not install or use the software.
2. License Usage Regulation (Freemium and Premium)
Juan Romero Domínguez grants the user a license to use the software subject to the following conditions:
- Personal and Non-Transferable Use: The license granted (for both "Freemium" and "Premium" plans) is individual, for private, non-commercial, and non-transferable use. Resale, distribution, sublicensing, reverse engineering, or decompilation of the extension is strictly prohibited.
- Freemium Plan: Allows the use of basic volume boost features and standard Equalizer control on a single device.
- Premium Plan: Provides access to advanced sound tools (Dynamic Engine, Clarity adjustment, No-Stop Mode for YouTube, and professional EQ presets). Usage is limited to the maximum number of browsers/sessions specified at the time of purchase and associated with the registered email account.
3. Subscription, Renewal, and Cancellation Policy
Volume Audio Premium licenses function via recurring monthly or annual subscriptions managed automatically:
- Billing Ecosystem: All payment processing, bank data storage, and renewal control are handled through the secure infrastructure of ExtensionPay (license processor) and Stripe (secure payment gateway).
- Automatic Renewal: Unless cancelled before the end of the current period, the subscription will renew automatically and the corresponding charge for the contracted plan (monthly/annual) will be applied to the registered card.
- Cancellation Policy: The user can cancel their subscription at any time autonomously through the license management panel provided by ExtensionPay within the extension. Cancellation will stop future automatic renewals, while maintaining Premium functionality until the previously paid period expires.
4. Limitation of Liability for Technical and Hardware Constraints
Volume Audio operates at the browser level and relies entirely on the technical architecture provided by web browser developers (such as Google Chrome, Microsoft Edge, Opera, etc.). Therefore, it is stipulated that:
IMPORTANT NOTICE:
The user acknowledges that Volume Audio is not responsible for any loss of functionality, degradation of sound quality, or inability to operate the Equalizer due to unilateral changes, security updates, or technical restrictions imposed by Chromium or app stores (e.g., Web Audio API processing restrictions in Manifest V3).
The software is provided "as is" and "as available", without express or implied warranties that the resulting audio will not suffer from dropouts or variations, as the codecs and web players of media platforms are constantly evolving.
Quantitative Limitation of Liability: To the maximum extent permitted by applicable law, the total liability of Juan Romero Domínguez to any user for any damage (including hardware audio damage or hearing issues), claim, or loss arising from the extreme use of the volume boost shall be strictly limited, in the aggregate, to the total amount actually paid by the user for the subscription to this software during the twelve (12) months prior to the event causing the claim.
5. Applicable Jurisdiction and Law
These terms are governed in their entirety by Spanish legislation. For the resolution of any dispute, conflict, or legal claim derived from the use of this software or this portal, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Spain, waiving any other venue that may correspond to them.
6. Modification of Terms
We reserve the right to modify these terms at any time due to regulatory changes or product updates. Changes will be posted in this section indicating the date of the last update. Your continued use of the software after the effective date of the changes constitutes your tacit acceptance of the new terms.
